The new traffic law has already been published in the Official Gazette (BOE la Ley 6/2014), law enters into force in a month with important developments in the field of road safety on the roads and cities and remains of the new regulation of circulation that is expected to come into force before summer.
The most important new features are the following, which enter into force within a month except the modification of speed limits, the measures relating to the child restraint system, which will come into force when the regulation is adopted.
Restrictions on vehicles for environmental reasons
One of the most innovative aspects of the law is that it expressly the possibility of restricting access or circulation by pathways to certain vehicles for environmental reasons, as set out in the Plan air where it foresees the creation of a State regulatory framework for the introduction of low-emission zones.
-Are forced to permanently register in Spain all vehicles used in national territory by foreign residents or owners of establishments or enterprises.
-Establishes the procedure for the cross-border exchange of information on traffic offences when committed with a vehicle registered in a State of the EU in another country. In short, it provides access to records
-The reform of the law opens the door to increase up to 130 kilometers per hour maximum limit in certain stretches of motorways and highways and to reduce the maximum speed in 10 km/h on secondary roads, as well as the establishment of zones 20 km/h and 30 km/h in cities. Not enter into force until the adoption of the regulation.
-Prohibit traps or radar detectors. Its use will fine 200 Euros and the 3 points of the license retirement. (Inhibitors are already prohibited and fined 6,000 Euros and 6 points).
-Weight and age is replaced by height, to the now force to use (SRI) child restraint systems, which will be mandatory for children measuring up to 1.35 m. In any case, not travel in the front seats even if they used a SRI, unless all the rear is occupied by other minors.
-Can immobilize the vehicle if it does not use the child restraint device.
The new text makes reference to the use of helmets mandatory for cyclists and occupants of bicycles on intercity roads, as it was already established and introduced a novelty:
-Children under 16-year-old will have to wear a bike helmet where they are moving through city. This element is mandatory on-road for all ages.
-Bicycles may not be immobilized, although his driver is fined for a violation which, in the case of motor vehicles, would entail that immobilization.
In addition, are allowed to circulate below the speed limit and reinforcing cyclist’s safety measures when they are developed by other vehicles:
-the vehicle that overtakes a bicyclist can take part or all of the adjacent or opposite rail.
-You must save a minimum lateral separation of 1.5 meters.
-In the overtaking it can not endanger or hinder the progress of cyclists travelling in the opposite direction.
Alcohol and drugs
One of the aspects to be amended substantially in the Act is the drugs on driving, picking up for the first time the principle of zero drug tolerance.
-It is forbidden to drive with presence of illegal drugs in the organism, with the exception of that used by prescription and therapeutic purposes (e.g. methadone). Driving under the influence will be fined 1,000 Euros.
-Remains the fine of 500 Euros for the consumption of alcohol, though it will be 1,000 if the rate doubled the maximum allowed or in case of recidivism in a year.
Violations shall be:
-Work on the road without prior notification to the authorization to the authority responsible for the management of traffic.
-Fall of the load of a vehicle on the road, creating danger for other users.
-Cause damage to the road infrastructure or alterations to movement due to the mass and dimensions of the vehicle.
-In traffic accidents caused by infringement of game species will be liable for any damages the driver of the vehicle, unless it can be claimed by the value of the animals.
-The owner of the track is only liable if it has not repaired the window or it has not indicated that there are loose animals.
-Increase to 20 days deadlines for appeals and to voluntarily pay the fines, which so far is 15 days.
-It is permitted not to stop and identify the offender when the agent complainant is carrying out monitoring and traffic control and lack the means to proceed with the prosecution of the vehicle.
-Includes the possibility to restrict access or circulation by pathways to specific vehicle for environmental reasons.
-Cranes that come to carry out the service of relief road have priority of passage.
-Creates the sectoral Conference on traffic and the upper Council of traffic is changed to, among other things, introduce new members, such as the associations of victims.
