Commission Details

The estate agent’s fee of 3.48 % on the purchase price including statutory VAT of currently 16 % is earned and due with the conclusion of the purchase contract (notarial conclusion of contract). If the VAT rate changes, the final price changes accordingly (from 01.07.2020 - 31.12.2020 the VAT rate is 16 %. From 01.01.2021 the VAT rate is 19% and therefore the commission on the purchase price is then 3.57% incl. statutory VAT.) The above commission must be included in the purchase contract. The amount of the estate agent’s gross fee shall be adjusted in the event that the tax rate is modified. Persons who act as agents and/or those who substantiate a purchase opportunity, Engel & Völkers Immobilien Deutschland GmbH (licensee of Engel & Völkers Residential GmbH) and its agent, if any, shall obtain a direct claim for payment vis-à-vis the purchaser (contract for the benefit of third parties, § 328 of the German Civil Code). We shall be entitled to enter into a fee agreement with the other party to the agreement.
