2. What local and foreign buyers should know about purchasing real estate in Malta

Here’s a brief overview of some Maltese regulations and a few of the benefit schemes applicable to property buyers you should be aware of when searching for your house, flat, villa or apartment. 

Once you’ve decided to buy a property and a Promise of Sale is signed, a provisional duty of 1% of the value of the property is due from the buyer, both resident and non-resident. When a property is transferred upon the signing of the final contract, a stamp duty totalling 5% of the declared price for both residents and non-residents is due (minus the already paid provisional duty). For real estate purchased in Gozo the stamp duty is a reduced rate of 2%. 


For non-residents seeking to purchase property in Malta, applications must be submitted to the AIP (Application of Immovable Property) section of Capital Transfer Duty (CTD) Department. 

First-time buyers who acquire a property vacant for at least 20 years, a property situated in a UCA (Urban Conservation Area) or a newly built house reflecting a traditional Maltese architectural style, will be eligible to receive a grant of €15,000 for a property in Malta and €30,000 for a property in Gozo. This applies to all final deeds signed by the 11th of October 2024.


Second-time buyers may also qualify for an incentive scheme if the following conditions apply: When a buyer transfers his residential immovable property (replaced property) and acquires another residential immovable property (replacement property) within 12 months from the date of transfer of the replaced property, the buyer can apply for a refund of the duty paid on the first €86,000 of the value of the replacement property.


If you purchase a property in an Urban Conservation Area (UCA) no taxes are levied on the first €700,000, with the normal rate of taxation applicable above that amount.
