2. Law regulations: What landlords should know about renting out property in Malta

In Malta, both residential and commercial accommodations are regulated by the Housing Authority in an effort not only to promote home ownership but also to improve housing conditions in Malta generally. Effective as of January 1st, 2020, new rent regulation rules were introduced governing the rental market, with emphasis particularly on rental contracts for residential properties. These new rules govern both short lets, i.e. rental agreements of up to 6 months but they focus primarily on leases of 1 year or longer. Also regulated are the cancellation and notice periods applicable to both landlords and tenants for leases of 1 year, 2 years, 3 years and longer, which serves to protect both parties.


In the event of small disputes landlords and tenants can now arrive at a quick settlement without resorting to lengthy and costly court proceedings by submitting their complaints to an adjudicating panel made up of professionals in the sector, which resolves such disputes related to maintenance, security deposits and bills.


Under the new rent regulations it is now mandatory that rental contracts are registered by the landlord within 10 days of the lease agreement coming into effect. The contract must also contain certain details to be deemed valid; these include the rental period; whether the lease can be extended and in what manner; the rental fee and how this will be paid; the amount required as a deposit; an inventory of the property in question. Registering both the rental contract and the inventory of the property is compulsory and can be filled out online.


From a tax perspective, renting out property is beneficial to landlords as rental income is taxed at a flat rate of 15%. The benefit is that rental income is taxed separately from your other income instead of being added to it, which could potentially result in a higher overall taxation rate. This applies to both residential and commercial property and to resident and non-resident landlords.
