Your Rights as a Data Subject
You have the right to information regarding the processing of your personal data (e.g., the origin of this data, the purpose of the processing, the methods of data processing). Furthermore, under certain conditions, you have the right to withdraw your consent to the processing of your data for the future, to restrict its processing, or to request the deletion of your data. Finally, you can stop receiving advertising materials or conducting market research or commercial communications at any time.

In principle, we only process personal data to the extent that you provide it to us via the contact form on our company website. Personal data is only processed when you have given us your consent or if the processing is permitted by law. For some of the services we offer on our company website, we require a minimum amount of data. We have marked this required data with an asterisk. Without this mandatory data, we cannot provide the services marked with this asterisk.
What data do we process about you (hereinafter "you" or "user")?
In connection with your use of our company website, we process personal data, including:

Contacting you by telephone (the legal basis is the performance of the contract or, in the case of using the telephone number for advertising purposes, your consent);
Sending you an email newsletter about our own offers and advertising, as well as third-party offers, to the extent permitted by law or based on your consent (the legal basis is either your consent or our legitimate interest in direct marketing, provided that the marketing is carried out in compliance with data protection and competition regulations);
In summary:
The legal basis for processing personal data is Article 6(1)(a) of the GDPR, insofar as the processing is based on consent, and Article 6(1)(a) of the GDPR. Article 6(1)(f) of the GDPR applies insofar as the basis for processing is a (pre-)contractual relationship, and Article 6(1)(f) of the GDPR applies insofar as it is a legitimate interest of ours. Insofar as the processing of personal data is necessary for compliance with a legal obligation to which we are subject, Article 6(1)(c) of the GDPR serves as the legal basis.
If the legal basis is your consent, you are entitled to withdraw your consent at any time without affecting the lawfulness of the processing of your personal data based on your consent prior to its withdrawal. If the legal basis is legitimate interest, you are also generally entitled, on grounds relating to your particular situation, to object to the processing of your personal data. Article 21 of the GDPR then applies.
Transfer of your personal data
In principle, we only transfer your personal data to third parties to the extent necessary for the performance of the contract, if we or the third party have a legitimate interest in the transfer, if we are legally obligated to do so, or if you have given us your consent. If personal data is transferred to third parties based on a legitimate interest, this will be stated in this privacy policy.
If your contact request concerns offers from other companies within the Engel & Völkers Group, we will transfer the personal data you provided to the respective Engel & Völkers Group company. Völkers after receiving your consent or – to the extent permitted by law – on the basis of what is known as legitimate interest. Furthermore, your personal data will not be passed on to third parties by us.
When referring to the “Engel & Völkers Group” in this privacy statement, we are referring to the companies belonging to the Engel & Völkers Group of Companies as defined in Section 15 et seq. of the German Company Law and to the licensing partners (masters) who are contractually linked directly or indirectly to this Group of Companies, to which we also belong. Data Transfer to Countries Outside the EEA
In addition to the section above entitled "Disclosure of Your Personal Data," the following applies:
Recipients of personal data may be located outside the EEA/UK. When personal data is transferred to sites outside the EEA/UK, we will ensure, as required by law, that your data protection rights are respected accordingly. This is either because the European Commission has determined that the country to which your personal data is transferred ensures an adequate level of protection (Article 45 of the GDPR), or the transfer is subject to appropriate safeguards (e.g., standard contractual clauses) of the European Union concluded with the recipient (Article 46 of the GDPR), insofar as the GDPR does not provide for an exception (Article 49 of the GDPR). You enter into a search or marketing contract with us, request a presentation, or commission a property valuation.
What data do we process about you?
When searching for, selling, or renting a property, requesting a presentation, or obtaining a property valuation, the following personal data about you is generally processed:
First name, last name, title, address, telephone number, data concerning the property you are looking for (in the case of a property search) or (in the case of property marketing or valuation) data concerning the property;
Email address, insofar as you have given your consent to receive advertising information, including offers or valuations of real estate, or if you wish to be communicated by email;
and (if it concerns the purchase, sale, or rental of real estate) bank details, identity information, a copy of an identity document (when buying/selling real estate) and land registry extract, electricity, heating oil, and/or gas bills, general overhead expense invoices, a declaration of division, minutes of the condominium association (decisions), a purchase agreement (in the case of a sale of real estate) or (if it concerns a rental of real estate) bank details, identity information, if necessary a CV, proof of income, proof of solvency, landlord confirmation, and a rental agreement.
Purpose of Processing and Legal Basis
We process this personal data for the following purposes:
Performance of a contractual or pre-contractual legal relationship – also through independent real estate agents who collaborate with us – including invoicing and credit checks (the legal basis is Art. 6(1)(b) of the GDPR and Art. 6(1)(f) of the GDPR; our legitimate interest in transmitting data to independent real estate agents stems from the freedom to choose to perform contractual relationships also with independent brokers or sub-brokers. The legitimate interest in carrying out credit checks stems from the legitimate interest in protecting against uncollectible debts);
Compliance with a legal obligation, particularly in connection with anti-money laundering legislation; (the legal basis is Article 6(1)(c) of the GDPR);
Advertising information about real estate that we or other licensing partners of the Engel & Gavre Group provide; Völkers markets (the legal basis is Article 6(1)(f) of the GDPR; our legitimate interest arises from the processing of personal data for direct marketing purposes. The legal basis is also your consent pursuant to Article 6(1)(a) of the GDPR, insofar as advertising information is sent to you by email, fax, or telephone.)
If the legal basis is your consent, you are entitled to withdraw your consent at any time, without this affecting the lawfulness of the processing carried out on the basis of consent prior to its withdrawal. If the legal basis is legitimate interest, you are also generally entitled, for reasons arising from your particular situation, to object to the processing of your personal data. Article 21 of the GDPR then applies.
Data Transfer
If your request (e.g., when requesting a quote) concerns offers from other Engel & Völkers Group licensing partners, Engel & Völkers will, with your consent, transfer the personal data you provided to the respective Engel & Völkers Group company.
Please also refer to Section III for further information regarding our Provision data.
In addition, as part of fulfilling a contractual relationship, we transmit personal data to contractual partners (owners, landlords, prospective clients) and to service providers such as notaries, lawyers, property managers, developers, and for credit checks or to supervisory authorities (e.g., for anti-money laundering documentation). We may also transmit your data to third parties within the legally permitted framework. Third parties to whom we transmit your personal data independently of our service provision include external advisors (e.g., lawyers and accountants), authorities in the context of their responsibility to fulfill legal obligations and/or enforce our rights (e.g., tax authorities, police, public prosecutors, courts), potential or current buyers of all or part of our assets and/or business, and other third parties, to the extent that you instruct us to transmit data or give us your consent.
Furthermore, we will only transfer your personal data to employees (permanent employees such as staff and independent real estate agents) and third-party companies (e.g., IT service providers, hosting providers, etc.) to whom we outsource services involving data processing as part of fulfilling our tasks.

We are searching for a property for you jointly with another Engel & Völkers licensing partner ("Provision")
If we are searching for a property for you jointly with another licensing partner, your data will only be transmitted based on your prior consent. Please note that both we, as your initial point of contact, and the Engel & Völkers Group licensing partner to whom your data is transmitted, process your personal data. Both we and this licensing partner are independently responsible for their respective data processing. Neither we nor this other licensing partner have access to each other's data and do not process your data jointly. If you wish to exercise your rights as a data subject, please first determine whether you wish to exercise them against us or against the other Engel & Völkers Group licensing partner that also processes your data.

What data do we process about you?
When you apply to us via our website or an advertisement, we process your name, address, contact information, and application details. Providing your address and contact information, indicated as mandatory data, is necessary to contact you regarding your application and to assign you to a position.
Purpose of Processing and Legal Basis
We process your personal data for the following purposes:
● Verification of your application for employment within our company (the legal basis is Article 6(1)(b) of the GDPR, where applicable in conjunction with Section 26 of the GDPR (for the scope of application in the Federal Republic of Germany)).
● Defense, where applicable, of legal rights exercised against us in the context of the application process, to the extent necessary (the legal basis is then our legitimate interest in meeting the burden of proof in a process in accordance with the general principle of equal treatment, Art. 6(1)(f) of the GDPR).
● We also process your personal data based on the consent you have previously given to inform you of interesting job offers (the legal basis is Art. 6(1)(a) of the GDPR).
If the legal basis is your consent, you are entitled to withdraw your consent at any time, without this affecting the lawfulness of the processing carried out based on consent before its withdrawal. If the legal basis is legitimate interest, you are also generally entitled, for reasons relating to your particular situation, to object to the processing of your personal data. Article 21 of the GDPR then applies.
We need your personal data to fulfill the processing purposes mentioned above. You are free not to provide us with any personal data. In this case, we cannot allow you to participate in the application process for current job openings.

Registration and Deletion of Your Data
We store your personal data for the period necessary to fulfill the purpose for which the data is collected and processed, including any mandatory retention periods in accordance with applicable laws (e.g., maintaining accounting records).
In the context of application processes that do not result in employment, your data is generally retained for six months for documentation purposes, and then deleted or destroyed, along with any documents you have sent us.With your consent to the processing of your data for future application processes, we will also retain it for a longer period accordingly.
