Buy and sell a property in Mallorca - Certificate of Occupancy

This is a certificate required by Spanish law aimed at controlling conditions relating to health and
safety in any building to be used for housing. This ensures that they meet the minimum requirements
needed for a building to be habitable. It is essential in order to be able to contract water, electricity and gas supplies.

There are various kinds of Certificate of Occupancy:

  • Primera ocupación (first occupancy): new buildings or existing ones where the renovation extended
    on more than 60% of the constructed area.
  • Renovación (renovation): when the certificate has expired.
  • Carencia: buildings completed before 1st of March 1987, and which have never had this certificate before.

Expiration period for Certificates of Occupancy: they expire after 10 years.
Issue period: generally 10‐15 days, rural land varies taking from 1 month to maximum 2 months

Issue fees:

12,02 € for homes.
24,04 € for locals.
6,01 € for place in residential building.
0,66 € for duplicate.

Other fees: 3,31€ for certify a copy.

-Documents required for “First occupancy” Cédula de primera ocupación, together with the application form:

a) Copy of title deeds.
b) Current photograph of the property, dated and signed by the architect or the building engineer.
c) Map with the location of the building, with the catastral data in the event that it is undeveloped land,
signed by the architect or the building engineer.
d) Municipal building works license.
e) The Final Work Certificate.
f) Occupancy certificate issued by “Dirección Facultativa de la obra” (signed by the architect or the
building engineer)

- Documents required for Cédula de renovación, together with the application form:

a) Copy of title deeds.
b) The last certification, or if not available:

‐ For urban ground: electricity bill.
‐ For rural ground, the electricity bill is not sufficient, you also are required to provide the
Final Completion Certificates (certificado final de obra).
c) Occupancy certificate (certificado de habitabilidad) signed by the architect or the building engineer.
d) Current image of the property, dated and signed by the architect or the building engineer.
e) Map with the location of the building, with the catastral data in the event that it is undeveloped
land, signed by the architect or the building engineer.

Documents c) d) e) – are prepared by the architect and she/he will require the following:

1. Building Permit or Final Construction Certificate
2. Former Certificate of Occupancy or electricity bill

Approximate architect fees:

180+VAT if the architect only prepares documents c) d) e), which means that the owner should apply
for the certificate himself (at the Consell deMallorca), otherwise fees stand at 250+VAT, which
includes all administrative procedures.

-Documents required for a duplicate of the certificate Duplicado de la cédula, together with the
application form:

a) Copy of title deeds.
b) Written declaration that no further building works have been done (form available).
c) Current photograph of the property, dated and signed by the architect or the building engineer.

-Documents required for Cédula por carencia, together with the application form:

a) Copy of title deeds.
b) Current photograph of the property, dated and signed by the architect or the building engineer.
c) Map with the location of the building, with the catastral data in the event that it is undeveloped
land, signed by the architect or the building engineer.
d) Occupancy certificate.
e) Land planning situation certificate “CERTIFICADO DE SITUACIÓN URBANÍSTICA” which should be
applied at the corresponding town council.

To apply for the Land Planning Situation Certificate "CERTIFICADO DE SITUACIÓN URBANÍSTICA" the applicant
must prove fulfillment of the following:

  • Construction completion was earlier than 1st of March 1987.
  • Existence or non‐existence of any pending building fines by the authorities.
  • That no works which would require a license for major building works have been made after the 1st of March of 1987.
