When we refer to the "Engel & Völkers Group" in this Privacy Policy, we mean the companies belonging to the Engel & Völkers group of companies pursuant to art. 42 Spanish Commercial Code as well as the (master) licence partners which are directly or indirectly contractually affiliated to this group of companies and to which we also belong.

In case of purchase/sale or rental of real estate, the bank details, identity details, copy of ID (in case of purchase/sale of real estate) as well as land register, electricity, oil and/or gas bills, general itemised bills, declarations of partition, WEG minutes (resolutions) and/or purchase contract (in case of sale of real estate) or in case of rental of real estate the bank details, identity details, CV if applicable, proof of salary, proof of creditworthiness, landlord's confirmation and/or tenancy agreement.
The one required by Mallorca Southwest to carry out your registration: name, email and password.
Personal information or not required to subscribe to the newsletter, such as your email.
Personal information or not, required to download the market report, such as: name, surname and email.
2.2.- Rights
We inform you that the completion of the forms is voluntary. However, if you do not fill in the mandatory fields (marked with an asterisk) the use of some functions of the site will not be possible or will be limited.
The personal data you provide will be incorporated and will be processed by Mallorca Southwest, in order to meet your requests.

Make studies about the effectiveness of the website, marketing, advertising and sales through the use of cookies (the lawful basis being our legitimate interest in improving the service or your consent, as appropriate).
Send you our newsletter via email (the lawful basis is your consent). You can unsubscribe from our newsletter by the email received or by contacting us at DataProtectionMallorcaSW@engelvoelkers.com. However, you will not be able to unsubscribe from certain correspondence from us, such as the messages related to the security of your data or the terms and conditions of Mallorca Southwest.
Manage the application processes in the job offers that we publish (the lawful basis being the establishment of pre-contractual relationships).
Store in our job bank the CV or Curriculum Vitae that you provide us to send you future new job offers (the lawful basis being your consent).
Share your CV or Curriculum Vitae with the entities of the Engel & Völkers Group located in the European Economic Area in order to be able to apply for job offers available in other offices (the lawful basis being your consent).
To manage and, where appropriate, investigate communications concerning allegedly irregular conduct or conduct contrary to applicable regulations (e.g. improper practices by suppliers) submitted through the Internal Reporting System, in accordance with Act 2/2023 and Directive (EU) 2019/1937, the lawful basis for such processing is compliance with a legal obligation (Act 2/2023) or the Controller’s overriding legitimate interest in preventing, detecting and sanctioning breaches.

Share your data with the Engel & Völkers Group entities located in the European Economic Area at an administrative level (the lawful basis being our legitimate interest in attending to your queries and other internal administrative purposes).
If applicable, to fulfill a valuation request of the property as described by the user, as well as the implied interest in the sale of the property as submitted by the valuation request (the legal basis being the fulfilment of the contract as well as your consent in the event that we need to share your contact data with i) a suitable licence partner of the Engel & Völkers Group based on expertise or geographical location or ii) to the company technically implementing the evaluation and (c) the legitimate interest in marketing our services or your consent in the case of the use of your contact data for direct marketing);
Fulfilment of the contractual relationship or a pre-contractual legal relationship - also by independent real estate consultants cooperating with us - including billing and credibility assessment (legal basis is Art. 6 I lit b. GDPR as well as Art. 6 I lit. f GDPR; the legitimate interest of us in connection with the transfer of data to independent real estate consultants derives from the freedom of choice to also fulfil contractual relationships with independent brokers or sub-brokers. The legitimate interest in carrying out credit checks follows from the legitimate interest in protecting against a loss of receivables);
Fulfilment of a legal obligation, in particular in connection with the Spanish anti-money laundering law or Ley 10/2010, de Prevención del blanqueo de capitales (legal basis is Art. 6 I lit. c GDPR);
Promotional information about properties that we or other licence partners of the Engel & Völkers Group market (legal basis is Art. 6 I lit. f GDPR; we have a legitimate interest in processing personal data for direct advertising. The legal basis is also your consent according to Art. 6 I a. GDPR, if the promotional information is sent to you by email, fax or telephone).
If we search for a property for you together with another licence partner, your data will only be transmitted based on your prior consent or legitimate interest to fulfill the request, depending on the case. Please note that both we, as your initial contact, and the licence partner of the Engel & Völkers Group to whom your data are supplied process your personal data. Both, we and this licence partner, are independently responsible for the respective data processing. This other licence partner and we do not have access to each other's data and do not process your data jointly. If you wish to assert data subject rights, please check in advance whether you wish to assert them against us or against the other licence partner of the Engel & Völkers Group who also processes your data.
Maintain the security of the Service, investigate illegal activities, enforce our terms and conditions and assist the security forces of the state in the framework of its possible investigations (the lawful basis being our legitimate interest in guaranteeing and maintaining the security of the Service and its users).
If the legal basis is your consent, you are entitled to revoke your consent at any time without affecting the lawfulness of the processing of your personal data carried out based on the consent until revocation. If the legal basis is the legitimate interest, you are also generally entitled to object to the processing of personal data relating to you at any time for reasons arising from your particular situation.
Mallorca Southwest does not use automated decisions, although it can generate basic user profiles, the lawful basis being our legitimate interest in direct marketing and with the purpose of providing personalized offers.
Likewise, Mallorca Southwest may use the information of the users in the form of aggregated and anonymous data to show them to third parties. You may also share statistics and demographic information about users and their use of the Service with third parties. But none of this will allow those third parties to identify you personally.
2.3.1.- In mails and contact forms
The website uses an TLS encryption that allows the user to securely send their personal data through standard type contact forms.
The personal data collected will be subject to automated processing and incorporated into the corresponding Record of Processing Activities of Mallorca Southwest.
In that sense:
Your IP will be collected, which will be used to check the origin of the message in order to offer you appropriate recommendations (for example, to present the information in the correct language) and to detect possible irregularities (for example, possible attempts to cyber attack on Mallorca Southwest), as well as data related to your ISP.
Likewise, you can provide us with your data via telephone, email and other indicated means of communication.
2.4.- Preservation of the data
Here you can check for how long we keep the personal data collected by Mallorca Southwest:
The disaggregated data will be kept without a cancellation period.
The user’s data will be conserved the minimum necessary, being able to stay up to:
- 5 years, according to art. 1964 of the Civil Code (personal actions without special term).
- 6 years, according to art. 30 of the Commercial Code (accounting books or invoice, for example).
- 12 months regarding applications at your own initiative or in response to a job advertisement.
- In case of purchase, sale or rental, 10 years according to the Spanish anti-money laundering law or Ley 10/2010, de Prevención del blanqueo de capitales.
- Regarding the whistleblowing channel, personal data shall be retained in the Internal Reporting System only for the period strictly necessary to determine whether an investigation should be opened and, in any event, for no longer than three (3) months from receipt of the report. Where an investigation is opened, the data shall be “frozen” (blocked) and kept for the duration of the investigation; once it has concluded, the data shall be stored in pseudonymised form for up to ten (10) years in order to demonstrate the proper functioning of the compliance model and to address potential liabilities. Reports that do not give rise to any follow-up action shall be kept in anonymised form for statistical purposes.
The subscribers’ data to the newsletter will be stored from the moment the user subscribes until they unsubscribe.
3.- Data shared with third parties
According to the purposes stated in this Privacy Policy, Mallorca Southwest will share the data from the users who are requesting information, specifically their names, email, phone and zip code with all the entities of Engel & Völkers Group located in the European Economic Area and third parties with whom the Service collaborates.
Mallorca Southwestrequires them to comply with these Terms of Use and Privacy Policy in whatever is applicable to them and they must also have their own. However, Mallorca Southwest will not be responsible for compliance with said policy.
On the other hand, under some circumstances, Mallorca Southwestmay share, use, preserve or disclose the personal information collected with third parties:
To provide the Service:
The service providers that provide functions on our behalf, such as payment services, web hosting, statistics control, IT, public administration, lawyers, notaries, banks, registries or other licenses from the Engel & Völkers Group. These service providers may collect and access the information that is necessary to perform their functions, but they are not allowed to share or use the information for any other purpose.
To cooperate with the competent authorities:
If we believe it is reasonably required to satisfy any law, legal process or legitimate interest. In any case, we will only provide the strictly required information.
To provide personal data to recipients that may be located outside the EEA/UK:
Where personal data is transferred to locations outside the EEA/UK, we will ensure, as required by law, that your data protection rights are adequately protected, either because the European Commission has decided that the country to which personal data is transferred ensures an adequate level of protection (Art. 45 GDPR) or the transfer is subject to adequate safeguards (e.g. standard contractual clauses) as agreed by the European Union and the recipient of the data (Art. 46 GDPR) unless the GDPR provides for an exception (Art. 49 GDPR). Furthermore, where necessary, we intend to agree to additional measures with recipients to ensure an adequate level of data protection.
Copies of the adequate safeguards (where we rely on them) and a list of recipients outside the EEA/UK are available on request. Please note that these copies may be redacted to the necessary extent to protect trade secrets or other confidential information.
