Assembly of the owners and management of the condominium

The community of co-owners meets at least once a year at the assembly, where they are informed about community matters and make resolutions. Motions may be brought before the assembly, subject to the observance of regulatory deadlines. In order to guarantee that the assembly proceed smoothly, it is worth sending the condominium owners a corresponding agenda list in advance and, if necessary, to attach appropriate offers for upcoming work.


Resolutions shall be subject to verification of the quorum and must be taken correctly according to the relevant procedure. Errors may lead to resolutions being contestable or void. Where a regulation does not settle a contentious matter, the provisions from the CC shall apply.


The quorum of an assembly shall be checked by the management at the beginning of each assembly. If the assembly does not have a quorum, the assembly cannot be held properly. The law requires that half of all co-owners, but at least two, and half of all value shares be present or represented. However, the regulations may set a different quorum.


Resolutions for which the law or the regulations do not prescribe any other majority, are taken with the simple majority of the co-owners present. The number of co-owners present or represented are decisive for calculating the majority. Value shares have no influence here. In the case of a qualified majority, resolutions are recorded by a per capita majority and a majority of the value shares.

The assembly of the owners chooses the management. The management, in turn, performs all acts of the administration of the community in accordance with the regulations and the law. Their responsibilities include inviting the floor owners to the assembly, preparing the annual accounts and the budget and the obtainment of offers. It moderates the assembly and keeps proper minutes thereof. It implements the resolutions of the assembly and advises the assembly on technical matters.
