Privacy Policy in relation to the joint search for real estate in the Engel & license partner network Völkers (Referral)
This privacy policy will be valid from May 28, 2020.
Stela Srl Unipersonale (hereinafter also referred to as "Engel & Völkers") has received your personal data from a company belonging to the Engel & Völkers license partner network. The disclosure of personal data is therefore based on your consent.
Since Engel & Völkers Immobilien GmbH is responsible for processing your personal data, it wishes to do the following in accordance with Art. 14 GDPR:
In our capacity as responsible authority, we hereby inform customers and interested parties about the processing of personal data, which is carried out in the context of a joint search for Engel & Völkers license partners. In particular, we collect and process:
● Name, surname, title, address, telephone number, real estate inquiry information (in the case of a property search) or property information (in the case of real estate marketing);
● Email address, provided that the user has consented to receiving promotional information, in particular the offer of real estate;
● and (in the case of purchase / sale or rental of real estate) bank details, identity information, copy of identity document (when purchasing a property), land registry, electricity, diesel or gas bills, individual general payment expenses, purchase contract (in the case of renting a property) bank details, identity information, CV, salary, proof of creditworthiness, leasing.
Hereinafter, these data will be referred to as "data" or "personal data".
Purpose of processing
Engel & Völkers as the responsible body processes personal data for the following purposes:
● Fulfillment of the contractual relationship also by independent real estate consultants, including invoicing and bank checks (legal basis is Art. 6 GDPR and Art. 6 I letter f GDPR; the legitimate interest of Engel & Völkers in the transfer of data to real estate consultants arises from the free choice to conclude contractual relationships also with independent intermediaries or sub-intermediaries. The legitimate interest in carrying out credit checks arises from the legitimate interest in protecting against bad debts);
● Advertising information about properties marketed by Engel & Völkers or license partners of the Engel & Völkers Group (legal basis is Art. 6 I lit. f. GDPR; the legitimate interest of Engel & Völkers arises from the processing of personal data for direct marketing purposes.)
Disclosure of data
Your personal data will only be passed on by Engel & Völkers within the scope of the contractual relationship, if necessary with your prior consent. In particular, the data will be passed on to contractual partners and/or potential contractual partners, notaries and land registry offices. In this context, Engel & Völkers is also subject to the Anti-Money Laundering Act and is therefore obliged to pass on data to supervisory authorities if necessary. Your data will also be passed on to independent real estate consultants of Engel & Völkers.
Access to data
Personal data is processed by Engel & Völkers, specifically by:
● Collaborators (permanent employees and freelance real estate consultants) and consultants who provide the services offered;
● Third-party companies (e.g. IT service providers, hosting providers or the shipping company rauch) to which Engel & Völkers has outsourced services relating to processing operations in the context of order processing;
Disclosure of data to non-EEA countries
In principle, Engel & Völkers does not transfer personal data to non-EEA countries without your consent. The servers used by Engel & Völkers are located within the European Union.
If your request concerns companies of the Engel & Völkers outside the European Union, we will transfer data based on your consent.
In cases involving the transfer of personal data to countries that do not apply the same level of protection as within the European Union and in the absence of your explicit consent to the transfer of data to these countries, Engel & Völkers ensures that certain contractual obligations in accordance with data protection law (including the execution of the EU standard clauses approved by the European Commission) are agreed with all service providers, in the event that Engel & Völkers cannot rely on other legal principles for the transfer of personal data.
Storage and deletion of data
Engel & Völkers stores personal data relating to a contractual relationship for the duration of the retention period, in accordance with the statutory provisions.
Furthermore, Engel & Völkers will retain user data in connection with the receipt of advertising information until the user revokes their consent.

You have the right to receive information about the processing of your personal data (e.g. the origin of this data, the purpose of the processing, the means of processing the data). Privacy policy in relation to a spontaneous application or a job advertisement
Engel & Völkers Immobilien GmbH (hereinafter "Engel & Völkers") manages, as the body responsible for the personnel selection process (hereinafter "personnel selection"), the personal data.
Personal data includes, among other things, first name, last name, email address, telephone number, curriculum vitae and any other data and attached documents (hereinafter jointly referred to as “personal data”).
By participating in the personnel selection process and sending us your application, you make your
personal data available to Engel & Völkers.
Purpose of data processing
Engel & Völkers processes your personal data for the following purposes:
● Verification of your application for employment within our company (the legal basis is the pre-contractual relationship pursuant to Art. 6 I lit. b GDPR and/or the consent given pursuant to Art. 6 I lit. a GDPR, in the case of an application via the online application portal of Engel & Völkers AG).
● Defense against any claims against Engel & Völkers from the recruitment process, if necessary (legal basis is the legitimate interest of Engel & Völkers in fulfilling its obligations of proof in the context of a process under the Equal Opportunity Act (AGG); Art. 6 I et f GDPR).
● Engel & Völkers also processes personal data on the basis of the previously given consent, in order to inform applicants of interesting job offers. These offers will be sent to users at regular intervals by the specific department of Engel & Völkers to which they have applied.
Engel & Völkers requires the personal data of its users in order to be able to fulfil the aforementioned processing purposes. The user has the right not to provide personal data to Engel & Völkers. In this case, we cannot include the latter in the personnel selection process for open job offers.
Requirement for data transmission and consequences of revoking consent to data processing
We process personal data only if necessary. The processing takes place in digital or paper form.The processing of personal data also includes collection, recording, management, storage, modification, selection, comparison, access, communication.

Access to personal data and/or forwarding of such data to third parties
Your personal data is processed by the employees of Engel & Völkers or persons with equivalent duties. In particular:
● Collaborators and consultants responsible for the personnel selection process (such as personnel from the Engel & Völkers Personnel Department as the responsible body;
● Administrators and other trusted IT Support employees who are assigned and authorized to support the personnel selection process from a technical point of view (e.g. Customer Service or IT Office employees);
● Third parties (e.g. IT service providers or hosting providers, etc.), to whom Engel & Völkers has transferred and/or commissioned such activities. These are so-called contract providers.
Your data will not be forwarded to third parties except in these cases.
If you have applied via the Engel & Völkers AG application portal, your application documents have been forwarded to us by Engel & Völkers AG. During the recruitment process, you were informed about how Engel & Völkers AG handles personal data and can view this information at any time on the online application portal of the corresponding Engel & Völkers AG website.
