Register as a freelancer and collect unemployment benefit

On 10th of October, 2015, a new law came into force that encouraged the unemployed to consider the possibility of becoming self-employed. This legislation, officially known as the Law for the Promotion of Self-Employment and Social Economy (Ley de Fomento del Trabajo Autónomo y de la Economía Social), has introduced some important developments in the labour market, such as the possibility for those who wish to become self-employed to receive unemployment benefit. In some cases, during the first few months of setting-up the new business, freelancers don't tend to earn much income, so the monthly unemployment benefit will cover their expenses until they get back on their feet again.

Before, this legislation was only applicable to those aged 30 or younger, but now, this age restriction is removed and freelancers can receive payments for a maximum period of 9 months. It is important to bear in mind that you must register as unemployed within 15 days of losing your job; otherwise you will forfeit your right to receiving unemployment benefit.

It must also be mentioned that additional mandatory conditions do apply for being eligible in receiving this benefit. These include paying contributions into the social security system within the last 6 months, and being legally unemployed.

In addition, the freelancer will not be entitled to this benefit if it was his/her own decision to end the previous employment contract.

This law also introduces favourable terms, such as the possibility to cease receiving benefit payments and resume at a later date, as long as it is within five years of losing your job.
