General Terms and Conditions

1. The brokerage agreement between the client and us is concluded either by written agreement or by the client's use of our brokerage services based on, or with knowledge of, the commission payable for successful brokerage/referral services. Unless otherwise stipulated by the circumstances or by separate agreements, the agreement has a term of six months and is automatically extended by one month at a time unless one party terminates the agreement with one month's notice prior to its expiration.

2. The client is not entitled to engage other brokers to provide brokerage and/or referral services related to the property during the term of the brokerage agreement with us. In the event of a culpable breach of this provision, the client shall be liable to us for any resulting damages.

3. Our brokerage and/or referral services are based on information and details provided to us by our contractual partners or other authorized parties. We assume no liability for this information. Errors and/or prior sale or rental are reserved.

4. Provided there is no conflict of interest, we are entitled to act as a paid agent for the other party to the main contract as well.

5. If, as a result of our brokerage and/or referral services, a lease agreement is concluded between the parties to the main contract for the property instead of the originally intended purchase agreement, or vice versa, this does not affect our commission claim. In this case, the customary brokerage fee as defined in Section 653 Paragraph 2 of the German Civil Code (BGB) is due.

6. If, at the time of concluding the brokerage agreement, the client is aware of the contractual opportunity concerning the offered property and the willingness of the other party to the main contract to enter into the contract (prior knowledge), or if the client acquires this knowledge from a third party during the term of the brokerage agreement, the client must inform us immediately.

7. Our property brochures, the property/contract-related information we provide, and all our brokerage and/or referral activities are intended solely for the addressee(s). The client is obligated to treat this information confidentially after the conclusion of the brokerage agreement and not to disclose it to third parties. If the client culpably violates this obligation, they are liable to us for damages if our brokerage and/or referral activities are unsuccessful as a result. If the main contract is concluded with a third party due to the unauthorized disclosure of the information, the client is liable to us for payment of the lost commission.

8. The commission claim is due upon conclusion of the legally valid main contract, in accordance with Section 652 Paragraph 1 of the German Civil Code (BGB), provided the main contract is based on our contractual brokerage/intermediary services. The client is obligated to inform us immediately when, for what fee, and with which parties the main contract was concluded. This obligation to provide information is not affected by the fact that the main contract is subject to a condition precedent and this condition has not yet been fulfilled.

9. The client may only assert rights of retention or set-off against our commission claim if the client's claims are based on the same contractual relationship (brokerage agreement) or if other claims are undisputed or have been established by a final and binding judgment.

10. We do not participate in dispute resolution proceedings before a consumer arbitration board.

11. We do not review tax issues or provide advice on tax consequences related to the brokered/proven transaction.
