A declaration of division is essentially defined by three central elements when several owners purchase a house, flat or plot of land. One of these is the partition plan, which is the prerequisite for the joint land register entry. Based on an exact drawing of the building, the partition plan determines which parts of the property are considered common property, i.e. may be used equally by all owners, and where there is special property that may only be used by certain owners - such as certain rooms, garage spaces or garden plots.

The second element of the declaration of division is a so-called certificate of separation, which confirms that condominiums or partial ownership are sufficiently separated from other units by structural measures. Finally, a community regulation is usually established. These contain all the rights and obligations of the respective part-owners and in this way coordinate the maintenance, care or management of the Hamburg property, for example. The community rules can be drawn up individually by the owners and can also include modernisation guidelines, usage regulations or information on the regular owners' meeting.

Once the declaration of division has been finalised, it is also notarised by a notary - only then do the statements made there become effective.
