Your Rights as a Data Subject
You have the right to obtain information about the processing of your personal data (for example, the origin of these data, the purpose of processing, the modalities of data processing). Furthermore, under certain conditions, you are entitled to object to the processing for the future, to restrict it, or to request the deletion of the data. Finally, you may at any time prevent the sending of advertising material or the performance of market research or commercial communications.

Please note that your right to erasure is subject to limitations. For example, we must not—and may not—delete data that we are required to retain due to statutory retention obligations. I. Collection and Processing of Personal Data When Visiting Our Company Website
We generally process personal data only insofar as you provide it to us via the contact forms available on our company website. Personal data is processed only if you have given us your consent or if the processing is permitted by legal provisions. For certain services that we offer on our company website, we require a minimum amount of data. These mandatory fields are marked with an “asterisk”. Without the mandatory information, we cannot provide the services marked accordingly.

1. Which data do we process from you (hereinafter “you” or “user”)?
When you use the website for informational purposes only, meaning if you do not register or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which are technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 para. 1 sentence 1 lit. f GDPR):

In the case of more than purely informational use of our company website, we process personal data, namely:
Email address, first name, last name, title, address, telephone number, property data – referred to in connection with this privacy policy as “data” or “personal data” – which are provided by you in connection with the services offered on our company website (e.g. in the context of contact requests and newsletter mailings as well as the market price assessment (“valuation”) of real estate). In addition to the purely informational or other use of our website, we offer various services that you can use if interested. For this, you will generally need to provide additional personal data, which we use to provide the respective service and for which the above-mentioned principles of data processing apply. We process personal data that we receive from prospective customers and/or our clients or their representatives/authorized persons or employees during the initiation of a business relationship and/or in the context of our business relationship. Furthermore, we process personal data when you visit our websites (including social media such as Facebook, Instagram, etc.). This means that we collect your personal data in particular when you contact us, show interest in our products, register on our websites, contact us via email, telephone, or a contact form, or use our products and services within existing business relationships. Moreover, insofar as necessary for providing our services, we process personal data that we have lawfully received from other companies of the Engel & Völkers group or from other third parties (e.g. for the execution of orders, fulfillment of contracts, or based on your consent). Additionally, if necessary for our service, we partially process personal data that we have lawfully obtained from publicly accessible sources (e.g. debtor registers, commercial and association registers, press, media, internet) and are permitted to process.

Engel & Völkers uses the Google Analytics web analytics service from Google Inc. (“Google”) to analyze the use of the websites. Information generated by cookies about the use of the websites is generally transmitted to a Google server in the USA and stored there. Engel & Völkers uses Google Analytics exclusively with the extension “ga (‘set’, ‘anonymizeIp’, true)” to ensure that IP addresses are processed only in abbreviated form and to exclude any direct link to individual persons. Google may transfer data to third parties if required by law or if third parties process the data on behalf of Google. Google will not disclose the users’ IP address in connection with other Google data. b) Universal Analytics
Engel & Völkers uses the Universal Analytics features provided by Google. These functions enable Engel & Völkers to record and analyze sociodemographic data about users using a Google ID (if available) and cookies generated by Google from advertising content (DoubleClick). If a Google ID is available, the data controller will also record this data across all devices (e.g. if users use a smartphone and a PC) to analyze visitor flows across devices. This website does not use profiling cookies.

Google Remarketing and Retargeting
We use the Google Analytics advertising functions, which allow users who have already visited the website and shown interest in certain offers to be targeted again through advertising on the pages of Google partner networks. Advertising is displayed by using cookies that analyze user behavior during a visit to the website and send targeted product recommendations and advertisements based on the users’ interests.

Facebook Remarketing and Retargeting
We use remarketing technology for advertising on Facebook. This website contains links to the main social media network pages (e.g., Facebook and Twitter). 2. Purpose of Processing and Legal Basis
We process your data for the following purposes:
· Fulfillment of contact requests (legal basis is contract fulfillment and — in case of transferring user data to other Engel & Völkers Group license partners (see definition below in section 3) — your consent.)
· If applicable, fulfillment of requests for a market-price-based evaluation of the property described by the user as well as the transmitted sales interest (legal basis is contract fulfillment and, in case of entering contact details by the user and transferring them to a materially or geographically responsible Engel & Völkers license partner (see definition below in section 3) or to the company technically implementing the evaluation, your consent; and in the case of using contact details for direct marketing, the legitimate interest in marketing our own services or your consent);
· Contact via telephone by us (legal basis is contract fulfillment or, if the phone number is used for advertising purposes, your consent);
· Sending an email newsletter about our own offers as well as in-house and third-party advertising to the legally permissible extent or based on consent (legal basis is either your consent or our legitimate interest in direct marketing, as long as marketing is carried out in compliance with data protection and competition law requirements);

In summary:
The legal basis for processing personal data is Art. 6 I sentence 1 lit. a GDPR if the processing is based on consent, Art. 6 I sentence 1 lit. b GDPR if the basis of processing is a (possibly pre-contractual) contractual relationship, and Art. 6 I sentence 1 lit. f GDPR if the basis is our legitimate interest. If processing personal data is necessary to fulfill a legal obligation to which we are subject, Art. 6 I sentence 1 lit. c GDPR serves as the legal basis.
If the legal basis is your consent, you have the right to revoke your consent at any time without affecting the lawfulness of the processing carried out based on the consent before revocation. If the legal basis is legitimate interest, you are also generally entitled, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you. Art. 21 GDPR applies in this respect.

3. Disclosure of Your Personal Data
Your personal data will only be disclosed to third parties by us if this is necessary for the fulfillment of a contract, if we or the third party have a legitimate interest in the disclosure, a legal obligation exists, or if you have given your consent. If data is transmitted to third parties based on a legitimate interest, this is explained in these privacy policy provisions.
If your contact request concerns offers from other companies of the Engel & Völkers Group, we transmit the personal data you provided in this case to the respective company within the Engel & Völkers Group after your prior consent or — if legally permissible — based on a so-called legitimate interest. Beyond this, your personal data will not be further disclosed by us.
When we refer to the “Engel & Völkers Group” in this privacy policy, we mean the companies belonging to the Engel & Völkers corporate group pursuant to §§ 15ff. AktG, as well as the (master) license partners directly or indirectly contractually affiliated with this corporate group, of which we are also a part. 4. Disclosure of Data to Non-EEA Countries
In addition to the above section “Disclosure of Your Personal Data,” the following applies:
Recipients of personal data may be located outside the EEA/UK. When personal data is transmitted to locations outside the EEA/UK, we will, as required by law, ensure that your data protection rights are adequately protected, either because the European Commission has decided that the country to which personal data is transmitted provides an adequate level of protection (Art. 45 GDPR) or the transfer is subject to appropriate safeguards (e.g., Standard Contractual Clauses) of the European Union agreed with the recipient (Art. 46 GDPR), unless the GDPR provides an exception (Art. 49 GDPR). Furthermore, we intend, where necessary, to agree on additional measures with the recipients to ensure an adequate level of data protection. Copies of the adequate safeguards (to the extent we rely on them) and a list of recipients outside the EEA/the United Kingdom can be requested. Please note that these copies may be redacted to the extent necessary to protect trade secrets or other confidential information.
If your request concerns license partners of the Engel & Völkers Group outside the European Union, we will transmit your data to the locally/technically responsible license partner after your consent.

II. You Conclude a Search or Marketing Contract with Us, Request a Property Brochure, or Commission a Property Valuation
1. What Data We Process About You
When searching, selling, or renting a property, requesting a brochure, or performing a property valuation, the following personal data is regularly processed:
· First name, last name, title, address, telephone number, information about the property search (in the case of a property search) or (in the case of property marketing or valuation) information about the property;
· Email address, if you have consented to receive advertising information, particularly regarding property offers or valuations, or if you wish to communicate via email;
· and (if a purchase/sale or rental of a property occurs) bank account information, identity information, ID copy (in the case of property purchase/sale), land registry, electricity, oil and/or gas bills, general itemized billing, condominium declaration, homeowners’ association protocols (resolutions), purchase contract (in the case of property sale) or (if a property is rented) bank account information, identity information, if applicable, resume, proof of income, credit report, landlord confirmation, rental contract.

2. Purpose of Processing and Legal Basis
We process this personal data for the following purposes:
· Fulfillment of the contractual relationship or a pre-contractual legal relationship — including by independent real estate consultants cooperating with us — including billing and credit checks (legal basis is Art. 6 I lit. b GDPR as well as Art. 6 I lit. f GDPR; our legitimate interest in sharing data with independent real estate consultants arises from the freedom to also fulfill contractual relationships with independent brokers or sub-brokers. The legitimate interest in conducting credit checks arises from the legitimate interest in protecting against payment defaults.);
· Fulfillment of a legal obligation, particularly in connection with the Money Laundering Act (legal basis is Art. 6 I lit. c GDPR);
· Advertising information about properties marketed by us or other license partners of the Engel & Völkers Group (legal basis is Art. 6 I lit. f GDPR; our legitimate interest arises from processing personal data for direct marketing purposes. The legal basis is also your consent according to Art. 6 I lit. a GDPR if the advertising information is transmitted by email, fax, or telephone.)
If the legal basis is your consent, you are entitled to revoke your consent at any time without affecting the lawfulness of processing carried out based on the consent before revocation. If the legal basis is legitimate interest, you are also generally entitled, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you. Art. 21 GDPR applies in this respect.

3. Disclosure of Data
If your request (e.g., a valuation request) concerns offers from other license partners of the Engel & Völkers Group, Engel & Völkers transmits the personal data you provided in this case to the respective company within the Engel & Völkers Group after your prior consent.
Please also refer to our information on “Referral” in section III.
Furthermore, in the course of handling a contractual relationship, personal data is disclosed to contractual partners (owners, landlords, prospective buyers) and supporting service providers such as notaries, lawyers, property managers, developers, as well as in the course of credit checks or to supervisory authorities (e.g., for money laundering documentation). Additionally, your data may, within the legally permissible scope, be disclosed to third parties. These third parties include external advisors (e.g., lawyers and auditors), authorities within their competence to comply with legal obligations and/or protect our rights (e.g., tax authorities, police, public prosecutors, courts), potential buyers or acquirers of all or part of our assets and/or activities, as well as other third parties if you instruct us to disclose data or give your consent.
Moreover, your personal data is only disclosed to employees (permanent employees such as staff and freelance real estate consultants) and third-party companies (e.g., IT service providers, hosting providers, etc.) to whom we have outsourced services with processing operations under a data processing agreement.

4. Disclosure of Data to Non-EEA Countries
In addition to the preceding section “Disclosure of Your Personal Data,” the following applies:
Recipients of personal data may be located outside the EEA/UK. When personal data is transmitted to locations outside the EEA/UK, we will, as legally required, ensure that your data protection rights are adequately protected, either because the European Commission has determined that the country to which personal data is transmitted provides an adequate level of protection (Art. 45 GDPR) or the transfer is subject to appropriate safeguards (e.g., Standard Contractual Clauses) agreed with the recipient (Art. 46 GDPR), unless the GDPR provides an exception (Art. 49 GDPR). III. We Search for a Property for You Together with Another Engel & Völkers License Partner (“Referral”)
If we search for a property for you together with another license partner, your data will only be transmitted based on your previously given consent. Please note that both we, as your first point of contact, and the Engel & Völkers Group license partner to whom your data is referred, process your personal data. Both — we and this license partner — are independently responsible for the respective data processing. We and this other license partner do not have mutual access to each other’s data and do not process your data jointly. If you wish to exercise data subject rights, please first check whether you wish to assert these rights with us or the other Engel & Völkers Group license partner who also processes your data.
How we process your data in connection with marketing your property, what rights you have in this context, and who your contact persons are if you wish to exercise data subject rights are described above.

IV. You Apply Proactively or in Response to a Job Posting
1. What Data We Process About You
If you apply via our website or a job posting, we process your name, address, telecommunications, and application data. Providing your address and telecommunications data, as mandatory information, is necessary to contact you regarding your application and to assign the application.

2. Purpose of Processing and Legal Basis
We process your personal data for the following purposes:
· Examination of the application for an employment relationship within our company (legal basis is Art. 6 I lit. b GDPR, if applicable in conjunction with § 26 BDSG for Germany);
· Defense against possible legal claims arising from the application process, if necessary (legal basis is our legitimate interest in fulfilling our burden of proof in a procedure under the General Equal Treatment Act (AGG); Art. 6 I lit. f GDPR);
· Additionally, we process your personal data based on previously given consent to inform you about interesting job offers (legal basis is Art. 6 I lit. a GDPR).
If the legal basis is your consent, you are entitled to revoke it at any time without affecting the lawfulness of processing carried out based on the consent before revocation. If the legal basis is legitimate interest, you are also generally entitled, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you. Art. 21 GDPR applies in this respect.
We require your personal data to fulfill the processing purposes outlined above. You are free not to provide us with any personal data. In this case, we cannot allow you to participate in the application process for open positions.

3. Disclosure of Data
Your personal data will only be disclosed to third parties by us if this is necessary for contract fulfillment, if we or the third party have a legitimate interest, a legal obligation exists, or if you have given consent. If data is transmitted to third parties based on legitimate interest, this is explained in these privacy policy provisions.
If you applied via the global online job portal of Engel & Völkers Holding GmbH, your application documents were transmitted to us by Engel & Völkers Holding GmbH. How Engel & Völkers Holding GmbH processed your personal data was explained to you during the application process, and you can view it at any time via the global online job portal on the respective website of Engel & Völkers Holding GmbH.

We store your personal data for the period necessary to achieve the purposes for which the data is collected and further processed, including any retention periods required by applicable law (e.g., retention of accounting records).
In the context of application procedures that do not result in employment, your data will regularly be retained for six months for documentation purposes and thereafter deleted or destroyed, along with any documents you have provided. With your consent for the processing of data for future application procedures, we will also retain this data for a correspondingly longer period.
